General conditions for using the services

The services of Lenake, a brand owned by CARACCI Emanuele, can only be used for activities that comply with current legislation.

Lenake reserves the right to suspend or cancel the availability of services without refund (from suspension of services to cancellation of the account) even without notice, at its sole discretion.

Lenake staff does not access and control the data and content entered by customers in the use of the services.

Lenake, ensuring the guarantees provided by law, reserves the right to vary (with a view to improving the service) the conditions of use at any time at its discretion.

The publication of any material that violates one or more international and / or national regulations is prohibited. This includes, but is not limited to: copyrighted material, material that is legally considered obscene or offensive, information covered by professional secrecy or information that violates privacy laws.

It is expressly forbidden:

• the insertion of data that violate the current privacy legislation;
• the dissemination of copyrighted material, without prior authorization from the owner;
• the dissemination of material capable of committing offenses; e.g. cracks, serial numbers or codes

• illegal or unauthorized access or attempted access (often known as “hacking”) to computers or networks;
• the inclusion of content that offends or defames cultural, religious or ethnic people or groups; that encourage illegal activities.

1. The Customer is solely responsible for the security and correct use of the data contained

in the space associated with each service purchased.

2. The Customer is solely responsible for the correct conservation of the access credentials to the services, for any improper or malicious use of these credentials, even ifcarried out by third parties.
3. Access to the service control panel is personal, the Customer is required not to

disclose your access data; therefore access to the reserved area is not allowed

third parties not expressly authorized.
4. The Customer is obliged to keep incompatible scripts updated or corrected

vulnerable in the space associated with the services purchased; if updates

or corrections are not made, Lenake reserves the right to suspend the

service until actual update / correction.

5. In case of use of CMS (Content Management System, eg WordPress, Joomla, etc ..), the Customer is required to keep the software up to date with all the updates (bug fixes) available. In case of use of obsolete software for which no updates are available (bug fix), Lenake reserves the right to suspend the service.
6. The insertion in web pages of forms / forms (e.g. contact form, comment form, etc.) that automatically generate emails (form-to-mail), must be carried out in order to prevent their improper and automatic use by programs / scripts (e.g.

BOT). One way to implement this submission control can be, but is not limited to, the use of control techniques (e.g. CAPTCHA) that distinguish whether the form in question is used by a person or by a program ( BOT). In addition: the messages generated by these forms / modules must insert, in the sender and envelope of the message generated by the form, the address of an existing box in the domain of the site; the form message sending script must verify the correct configuration of an MX record for the domain to which the destination box belongs.

7. Customers may deposit data in the space associated with the services purchased, including texts, images, databases and other proprietary documents. Lenake will not process the data that the Customer enters in the space associated with the purchased service, which is an area publicly available through the Internet. Even by adopting the necessary security measures, the data present on the Internet is by its nature public data. The regulation of our service prohibits the use of the web space to deposit and process sensitive online data, to deposit data that violate the rights of privacy or copyright.

Lenake reserves the right to change the technical / technological characteristics of the services at any time.

The variations may be integrative, improving to optimize the functioning of the

service or limitations to restrict certain features.
Any changes will be published in the service sheet on the site.

The supplementary variations may or may not be applied to old subscriptions depending on the technical complexity of the modification of the service. Therefore they can be adopted

innovations or technologies that cannot be implemented on production servers that host existing subscriptions.

If the Customer wishes to benefit from the new technologies, introduced after the activation of the service, he can request the service upgrade or cancel it and purchase a new plan.

NB: If an already active service, subject to updating (or upgrading) or transferring to a new server, has additional active services (eg additional Host Pointers), the cancellation of the main service also cancels the connected additional services; in case,

therefore, of main services canceled to benefit from the new version of the same, the additional services associated with the old service must be re-subscribed and / or updated to be associated with the updated service.

Payment for the services must be made in advance for both activation and renewal.

Lenake reserves the right to change the prices of services at any time. These changes will be applicable from the first renewal immediately following the changes themselves.

Invoices and / or occasional withholding taxes (which will be used until € 5,000 are reached) are delivered in electronic format via e-mail to the email address provided by the Customer.
Lenake reserves the right to produce short accounting documents by hand to the customer.

Duration

The duration of the contract may vary depending on the service purchased: for example, for the domain registration service it has a duration of 12 months (365 days) while monthly, quarterly, half-yearly or annual for Web Hosting, Virtual Servers, Dedicated, Storage et similia.

The duration starts from the day the service is activated.

Renewal
The renewal of a service must be made no later than the expiry date of the service,

under penalty of suspension. As for the additional / additional services (add-ons), these will be renewed only if the main service to which they are associated is active.

To help manage renewals, Lenake will send 3 automatic warning messages to remind you of the expiration date of the service. Messages will arrive 30, 15 and 7 days before the deadline.

In the event that automatic renewal is chosen, Lenake will send a single notice to remind you to check the balance and avoid inconveniences due to exceeding the credit threshold.

In the case, however, of manual renewal, payment can be made by credit card, PayPal, bank transfer, MyBank or postal order.

In the event that the payment method used is the bank transfer or postal order, the evidence

the payment is not contextual to the payment itself, due to the time required for bank transfers; this implies waiting for these technical times before the renewal of the service is effective. To speed up this procedure, it is strongly recommended to send the payment notification by e-mail to [email protected] or via WhatsApp at 346 131 4467.

The updated economic conditions for the service to be renewed are available within the control panel, connecting with your credentials.

Useful tips for renewal

• Proceed with the renewal of the service in advance, a few days before the expiry date (the expiry date for the subsequent renewal will not be subject to advance payments or changes). Renewal of services beyond the deadline is a very complex procedure that often involves costs

additional.

• In the case of payment by bank transfer or postal current account bulletin, consider the necessary bank technical times and notify the payment by e-mail or viafax to speed up the renewal process.
• the Customer is required to ensure that his / her personal data is up to date, with e-mail addresses consulted daily, so that the various service communications delivered are read quickly.

Suspension of the service

In case of non-renewal, the service will be suspended on the expiry day and therefore will no longer be usable.

Domains associated with expired services cannot be transferred. To transfer them, however, it will be necessary to renew the expired service or register the domain name linked to the service.

Reactivation of expired and suspended services

In general, the reactivation of services renewed after the expiry date entails the payment of the service starting from the expiry date of the same.

.It domains in REDEMPTION: 7 days after the expiration of the service, .it domains enter the status of REDEMPTION. Therefore, after 7 days from the deadline, the renewal of the service will have an additional cost of € 10 + VAT.
ATTENTION: after 30 days from the deadline, the service will be canceled and can no longer be recovered, while the domain will be free for a new registration.

• .eu domains in QUARANTENA: at the end of the expiry month, .eu domains enter the QUARANTENA state for 40 days. They can be
  renewed by the end of the month of their expiration at no additional cost. If renewed after the end of the month of the expiration, they will have an additional cost of € 30 + VAT.

The Customer fully relieves Lenake of any civil and criminal liability deriving from the illicit, improper or anomalous use of the service, even if caused by third parties through the Customer’s system (control panel credentials, services).

Lenake is not responsible for the files contained in the space made available and anyone can have access to the information published by the Customer on its site, given the public nature of the Internet.

In no case will Lenake be held responsible for the malfunction of the service, if the malfunction derives from failures, overloads, interruptions of the data transmission lines,

telephone lines, electricity networks, worldwide and national networks.
